URGENT UPDATE: Court Strikes Down FCC's 1:1 Consent Rule

In a significant ruling in the case of Insurance Marketing Coalition Limited v. FCC, the United States Court of Appeals for the Eleventh Circuit has invalidated crucial aspects of a 2023 Federal Communications Commission (FCC) Order, including the contentious "one-to-one consent" mandate for robocalls and robotexts.
Initially set to take effect next week, the rule was overturned after the court determined that the FCC had exceeded its statutory authority by redefining "prior express consent" in a way that conflicts with the intent and language of the Telephone Consumer Protection Act (TCPA).
